Terms and Conditions for the use of the virtual post office (VPS) Rheinland-Pfalz

1. Regulation purpose and definitions
The present terms of utilisation regulate the use and the Operation of the virtual post office Rheinland-Pfalz (VPS). The VPS is operated by the Landesbetrieb Daten und Information, Valenciaplatz 6, 55118 Mainz (operator). The VPS is a communication platform which allows the secure transport of electronic messages. Beside the mere transport the VPS offers other services like the check of certified signatures according to the german signature law (SigG) and the check of the on malicious routines (viruses, trojans etc. ). The VPS can be used for the quick, easy and secure communication between natural and legal entities (i. e. enterprises) on the one hand and the state or municipal administrations as well as the participant chambers. In addition, the VPS can be used for the communication between the state and the municipal authorities. The VPS is component of the "rlp service", the eGovernment portal of Rheinland-Pfalz.

3. Mailboxes in the VPS
The operator provides a mailbox in the VPS for dispatch and receipt of electronic messages for users who have registered in the rlp-service. Messages in this mailbox are deleted after a period of 30 calendar days, since the VPS is designed as a platform for communication and not the archiving of messages. For the archiving of incoming post the users are responsible themselves.
4. Capacity limitation
Messages can be transported by the VPS, if they do not exceed a size of 30 MB. The users have to ensure that this message size is not exceeded.
Messages transported by the VPS, are check for infection by malicious routines in order to protect the users and the infrastructure of the VPS. If it is found that a message is infected with a malicious routine, the malicious routine respectively any infected files are deleted. Both the sending and the receiving person are notified about the occurence by the VPS (Report). The operator reserves the right to reject mass e-mails (spam) in order to protect the users and the infrastructure of the VPS. Such a rejection may be made if the affected message has a high probability of being spam based on an automated test procedure.
6. Data protection
In order to provide a user with a mailbox in the VPS, a registration in the rlp-service is required. In the registration and the use of the rlp-service and the VPS personal data is collected and processed. Details for the electronic processing of the data in the rlp-service, to which the users have agreed in the process of their registration in the rlp-service, can be found under the menu item "Data Protection" on the web pages of the rlp-service. Furthermore, in the use of the VPS, log data is stored. This log data will be shown in the reports, the users receive after the completion of the message transport in automated messages in their mailbox. It is the sender mailbox, recipient mailbox, timestamps and the list of file attachments with test results. The retention period for this VPS-specific log data is defined by the administrator of the authority mailbox that is the sender or receiver of the electronic message. Therefore this retention period is to be requested in the authority. The operator of the VPS stores these data on behalf of the authority in accordance with the specifications of the state data protection law of Rheinland-Pfalz. The aforementioned personal data is protected against unauthorized access by technical and organizational measures. The data is shared with the responsible departments of the state and local government and the participating chambers in the context of the operation of their services in order to avoid multiple registration and to simplify the process. A passing on to other third parties, for commercial or for any other purposes, does not take place. The aforementioned data falls under the protection of the German Telemedia Act (TMG). Due to this, the processing by the rlp-Service is only permitted if the user has agreed in in the collection and processing of the data. The consent to the present conditions of use includes the consent according to the TMG. The consent may be revoked at any time with effect for the future by the user by deleting the user account.
The operator shall be liable without limitation for the damages from the injury of life, body or health which are based on an intentional or negligent breach of duty on the part of an employee or an employee of a legal representative or a vicarious agent of the operator. The operator shall be fully liable for any other damage based on an intentional or grossly negligent breach of duty on the part of an employee or an employee of a legal representative or a vicarious agent of the operator, if it is no atypical damage and therefore hardly foreseeable. In the latter case, the claim for damages is excluded. The liability of the operator in respect of property or property damages, insofar as these are caused by slightly negligent breach of duty is limited to an amount of € 1.000,- per case of damage, if the damage is not atypical and therefore hardly foreseeable. In cases of force majeure or in the event of faults that are not the responsibility of the operator and the operator also does not have to represent, the operator is not liable for any damage. Although the operator regularly checks its software inventory on the infestation of viruses, a virus attack is technically not be ruled out with certainty. The operator is therefore not liable if a fault by viruses on the computers of the operator or the users should happen unless it has been caused wilfully or through gross negligence.
